Agreement to these terms
DwellTrack is operated by Abdessattar Hayouni in Québec. References to DwellTrack, we, or us in these terms refer to that operator. These terms describe the agreement for using DwellTrack, including its website, landlord workspace, tenant portal, and application tools. Review them before creating an account or using the service. Our Privacy Policy explains how personal information is handled; accepting these terms does not replace any separate consent required by law.
If you use DwellTrack on behalf of an organization, business, property owner, or landlord, you represent that you have authority to bind that party to these terms.
Accounts and responsibilities
- You must provide accurate account information and keep it current.
- You are responsible for safeguarding your login credentials.
- You are responsible for instructions you give, settings you enable, and access you authorize, including access for staff and other workspace members.
- You must notify us if you believe your account has been compromised.
- You must have legal capacity to enter this agreement. An account for an organization must be created and used by an authorized representative.
Your responsibility to follow applicable law
You are responsible for determining and following the federal, provincial, territorial, state, municipal, and other laws that apply to you, each rental property, and each person whose information you handle. Canadian features do not establish that DwellTrack is suitable for another jurisdiction or every tenancy. The location selected in the app does not determine your legal obligations.
- Check rent controls, permitted increases, deposits, interest, fees, payment allocation, receipts, and any required trust accounting.
- Follow tenancy, housing, licensing, habitability, maintenance, entry, accessibility, human-rights, and anti-discrimination requirements.
- Verify prescribed forms, required languages, signatures, notice periods, service methods, filing procedures, and deadlines before sending or relying on a document.
- Comply with privacy, consent, confidentiality, electronic-message, tax, accounting, and record-retention requirements.
DwellTrack does not supervise your rental business, verify your compliance, serve as your property manager, or assume your duties to tenants, applicants, tax authorities, or regulators. Using a template, reminder, calculation, or AI suggestion does not establish compliance or extend a deadline. Seek qualified local advice when needed.
Landlord and tenant data
DwellTrack provides tools for managing rental operations. Landlords and property managers are responsible for the accuracy, legality, retention, and use of the landlord, tenant, applicant, lease, payment, maintenance, tax, and document records they enter or upload.
You must have any required consent, notice, authority, or legal basis before adding tenant or applicant information to DwellTrack or sending communications through the service.
Provide appropriate notices to tenants and applicants, collect only information needed for a lawful purpose, restrict workspace access, and respond to privacy requests for records you control. Do not upload banking passwords, payment-card security codes, government identifiers, medical records, or other highly sensitive information unless a supported workflow requires it and you have lawful authority. DwellTrack remains responsible for its own obligations under applicable law.
Email forwarding: your responsibilities
You are responsible for selecting the emails, quoted conversations, and attachments you forward to DwellTrack's automated processing addresses, and for configuring and checking your forwarding rules. Forward only rental e-transfer payment notification emails or messages you deliberately intend Kevin to process, such as rental receipts, invoices, or supported instructions. Use the address provided for the intended workflow.
Do not forward your entire inbox, unrelated personal correspondence, passwords, sign-in or recovery codes, full bank-account or payment-card details, government identity documents, medical information, or other highly sensitive information. Review the complete message and attachments, remove unnecessary information, and have the required authority and lawful basis to share information about other people.
Forwarding authorizes the applicable processing only within the choices you have enabled. It does not independently verify a payment or guarantee an accurate record. You must review resulting entries and promptly stop or correct a forwarding rule that sends unintended messages. Turning off processing in DwellTrack does not stop delivery by your email provider.
Forwarded messages are received by Resend or the email infrastructure provider used for the workflow. Those providers may retain messages and logs under their own terms. DwellTrack also retains email content and processing records for supported workflows as explained in the Privacy Policy. You remain responsible for your forwarding choices; DwellTrack remains responsible for its own obligations under applicable law.
These automated-forwarding limits do not prevent you from emailing our published support contact about the service. Support correspondence is a separate purpose and may be retained to handle requests, maintain case history, resolve disputes, and meet applicable obligations. Share only information needed for the support request and do not send passwords, sign-in codes, or unnecessary sensitive records.
Acceptable use
- Do not use DwellTrack for unlawful, misleading, abusive, discriminatory, or harmful activity.
- Do not upload malware, attempt unauthorized access, interfere with the service, or bypass security controls.
- Do not use DwellTrack to harass tenants, applicants, landlords, or any other person.
- Do not submit false, inaccurate, or deceptive records or impersonate another person.
- Do not resell, copy, scrape, reverse engineer, or commercially exploit the service except as permitted by us.
Subscriptions and billing
DwellTrack offers free and paid plans and may offer trials or promotional access. Current pricing, plan limits, and included features are shown on the pricing page or inside the product.
If paid plans are changed, we will provide reasonable notice where required. Fees, taxes, renewal terms, cancellation rules, and refund policies will be presented at checkout or in the applicable plan terms. Unless otherwise stated, subscription fees are non-refundable after the billing period begins, except where applicable law or the stated plan terms require a refund. Nothing here removes a mandatory cancellation, refund, or other consumer right.
When a subscription ends or moves to a smaller plan, a workspace that exceeds the new managed-unit limit may become read-only until units are removed or a plan with enough capacity is restored. Existing workspace data remains available for review and export during that time.
No legal, tax, accounting, or financial advice
DwellTrack provides software tools, templates, summaries, and workflow assistance. It does not provide legal, tax, accounting, financial, real estate, or professional advice. You should consult qualified professionals for advice specific to your situation. No professional-client, fiduciary, agency, or advisory relationship is created by using the service or communicating with Kevin.
Kevin and other AI-assisted features
Kevin is an AI assistant, not a human professional. DwellTrack uses Google Cloud Vertex AI to access Google Gemini language models supporting Kevin and other AI-assisted features. Vertex AI is the processing platform; Gemini supplies the language models. Relevant prompts, documents, and workspace context may be sent to Google to perform the requested task, as described in our Privacy Policy.
AI assistance is off until you enable it in Privacy choices. Forwarded-email processing and automatic expense saving are separate choices and are off until authorized. AI processing responds to actions such as sending a request, submitting a receipt for extraction, generating insights, or forwarding email to DwellTrack. Forwarding rules you configure can trigger processing while you are signed out. When automatic logging is enabled, eligible forwarded receipts may be recorded without a separate confirmation for each receipt. Eligible direct commands to add or log an expense may also save it without a separate confirmation when automatic logging is enabled. Review your forwarding and Kevin preferences; turn off automatic logging if you want to approve each eligible expense before it is recorded.
AI can produce inaccurate, incomplete, fabricated, outdated, or biased information, even when an answer sounds confident. A confidence indicator, readiness score, suggested category, or completed action is not independent verification. You must check outputs against source records and applicable rules before using, sharing, confirming, filing, or acting on them. Review automatically recorded items promptly and correct errors. You remain responsible for your decisions and for settings and instructions you authorize.
Do not use AI output as the sole basis for accepting or rejecting an applicant, evicting a tenant, assessing a protected personal characteristic, or making another decision with significant legal or personal effects. Independently verify facts, use meaningful human review, and meet any required explanation or challenge rights.
Payment records, e-transfers, and expenses
Payment matching, email extraction, and ledger statuses are recordkeeping aids. An email notification, suggested match, recorded payment, or status such as Cleared does not independently verify that money reached your bank account or cannot be reversed. Confirm receipt with your financial institution. DwellTrack does not hold or transfer tenant rent through its notification workflows.
Check the payer, tenant, property, unit, amount, currency, date, rent period, charge allocation, credit, duplicate status, and source evidence. For expenses, verify the vendor, receipt, taxes, property, category, business-use proportion, and current-versus-capital treatment. Review both automated entries and manual confirmations. You are responsible for issuing accurate receipts, reconciling your accounts, and correcting records before relying on them.
Tax helper, reports, and your filings
Tax Helper, T776 worksheets, exports, calculations, expense categories, and AI tax-readiness reviews organize recorded information. They are not a filed tax return, a determination of deductibility, a tax opinion, an audit, or an assurance of CRA acceptance. DwellTrack does not submit your tax return or act as your accountant or tax representative through these tools.
You are responsible for the accuracy and completeness of your filings, including income, ownership shares, personal use, deductible amounts, capital expenses, capital cost allowance, GST/HST or other taxes, elections, supporting evidence, and deadlines. Review every report against original records and current tax rules; consult a qualified tax professional where needed. Keep required records and your own exports for the legally required period.
To the extent permitted by applicable law, DwellTrack is not responsible for an incorrect filing, disallowed deduction, missed deadline, assessment, penalty, interest, or other loss resulting from your inaccurate or incomplete records, failure to review or correct outputs, or reliance on the tools as professional tax advice. The liability limitations and mandatory-rights exceptions below apply; they do not remove obligations that the law places on DwellTrack.
Documents, communications, and deadlines
Check every lease, addendum, notice, rent increase, receipt, message, signature workflow, and AI document plan before use. A generated document or delivery status does not guarantee legal validity, enforceability, legally effective service, receipt by its intended recipient, or satisfaction of a tribunal or court requirement. Keep your own deadline calendar and proof of service. Maintenance tools are not an emergency response service; contact emergency services or appropriate local help directly for urgent danger.
Third-party services and your records
Connected email, AI, hosting, storage, and billing services can have outages, delays, or errors. Review permissions and any separate terms that apply to a service you connect. Maintain independent copies of records and documents you must retain; synchronization, exports, and backups do not replace checking that your required records are complete and accessible. This does not exclude DwellTrack's own statutory duties for providers it uses or personal information it handles.
Service availability and changes
We may update, modify, suspend, or discontinue parts of DwellTrack. We work to keep the service reliable, but we do not guarantee that it will always be available, uninterrupted, secure, or error-free. To the extent permitted by law, the service, templates, AI outputs, and reports are provided as available and without warranties of accuracy, fitness for a particular purpose, or a particular legal, tax, financial, or operational outcome. Mandatory warranties and remedies continue to apply. We will give notice of material changes or discontinuation where required by law.
Intellectual property
DwellTrack, including its software, design, branding, workflows, and content, is owned by DwellTrack or its licensors. You retain ownership of data you submit, but grant us the rights needed to host, process, display, transmit, and back up that data to provide the service.
Limitation of liability
To the maximum extent permitted by law, DwellTrack will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from or related to use of the service. Our total liability for any claim will be limited to the amount you paid to DwellTrack for the service in the three months before the event giving rise to the claim, or CAD $100, whichever is greater. This cap applies in aggregate to claims arising from the same event or related events, to the extent permitted by applicable law.
These exclusions and limits apply only where lawful. They do not exclude or limit fraud, intentional misconduct, gross negligence, bodily or moral injury, mandatory privacy or consumer remedies, or any other liability that cannot legally be excluded or limited. They do not prevent a complaint to a regulator or the exercise of a non-waivable right. DwellTrack does not claim immunity from its own legal duties.
Claims arising from your unlawful use
If you use DwellTrack for business or property-management purposes, to the extent permitted by law you agree to indemnify DwellTrack against reasonable third-party claims, damages, and legal costs caused by your unlawful use, unauthorized disclosure of personal information, infringement of another person's rights, or material breach of these terms. This obligation applies only to the extent you caused the claim, excludes losses caused by DwellTrack's own breach, negligence, or misconduct, and does not override mandatory consumer protections. We will notify you promptly and allow reasonable participation in the defence. No settlement may impose an admission, payment, or other obligation on you without your agreement.
Termination
You may stop using DwellTrack at any time. We may suspend or terminate access if we believe you violated these terms, created risk for the service or other users, failed to pay applicable fees, or used the service unlawfully. Where practicable and lawful, we will provide notice and an opportunity to address the issue. Access may be restricted immediately for security, unlawful activity, or urgent harm. Export required records before closing your account; contact support if you need assistance. Retention and deletion are subject to our Privacy Policy and applicable law.
Changes to these terms
We will identify the revision date and provide notice of material changes through an appropriate service or account channel before they take effect where required. We will request renewed agreement or consent when the law requires it. Changes do not retrospectively remove accrued rights or replace a required privacy consent. If you do not accept a change, you may stop using the service and cancel under the applicable plan terms and mandatory legal rights.
Governing law and contact
Subject to mandatory applicable law, these terms are governed by the laws of Québec and the federal laws of Canada applicable there. Your mandatory local rights, access to competent courts, and rights to contact regulators are preserved. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Questions about these terms can be sent to support@contact.dwelltrack.ca.
